On January 27, the Montgomery County Police Department's Family Crimes Division received information from an unnamed complainant that a 16-year-old Richard Montgomery High School student had engaged in sexual intercourse with Spear.
Investigation revealed that in May or June 2011, the 16-year-old student had told the complainant that she had engaged in sexual intercourse with an older man. The student gave no further details about the man at that time. In November 2011, the student disclosed to the complainant that the older man was Spear, who was her track coach at Richard Montgomery High School.
Further investigation revealed Spear had been the student's track coach since 2009. He had also been the student's 8th grade teacher at Julius West Middle School. During the time that Spear had been her track coach, she and Spear had been in constant contact with each other via cell phone during and after school hours and on weekends.
In April or May 2011, Spear contacted the student and asked if she wanted to meet. She agreed, and Spear took her to a residence in Rockville where they engaged in sexual intercourse. The following night, Spear took the student back to the same residence, and they again engaged in sexual intercourse.
An arrest warrant was obtained for Spear, and he was arrested Thursday without incident. Spear was charged with two counts of committing a fourth-degree sex offense. Bond information is unavailable at this time.
